1. Definition and subject of the contract
1.1 - This contract ("Contract") is a distance contract pursuant to art. 50 et seq. of Italian Legislative Decree no. 206 of 6 September 2005 ("Consumer Code"). The Contract concerns the sale of goods between Hosmotic Srl, with registered office in Vico Equense (NA), R. Bosco, 178, VAT no. 07672391211 ("Hosmotic Srl") and the customer (the "Customer"). The Contract is concluded when Hosmotic Srl accepts a purchase proposal sent by the Customer through the website www.hosmotic.com (the "Site"), as described in article 3 below.
2. Prices
2.1 - Prices of the products published on the Site are in euro and exclusive of VAT. VAT, calculated at each product's rate, and shipping costs are shown separately in the order summary before confirmation.
3. Purchase and payment methods
3.1 - To purchase on the Site you must sign up and activate your account.
3.2 - The Customer may choose one of the following payment methods: (a) bank transfer in advance; (b) PayPal or credit card.
4. Delivery - Complaints
4.1 - Hosmotic Srl delivers the products to the address indicated by the Customer within 30 (thirty) days of the conclusion of the Contract.
4.2 - Any complaint may be sent to: Hosmotic Srl, R. Bosco, 178 - 80069 Vico Equense (NA), Italy.
5. Product availability
5.1 - Hosmotic Srl accepts orders within the limits of the quantities available in stock. Acceptance of the purchase proposal is therefore subject to product availability. Hosmotic Srl undertakes to promptly inform the Customer of any unforeseeable stock shortages due to excess demand or other causes.
6. Warranties and support
6.1 - The legal provisions on warranties and support for the sale of goods apply to the products purchased by the Customer.
7. Customer obligations
7.1 - The Customer declares and guarantees: (i) to be of legal age; (ii) that the data provided for the performance of the Contract are correct and truthful.
8. Right of withdrawal
8.1 - If the Customer is a consumer, pursuant to art. 52 of the Consumer Code, as amended by Legislative Decree 21/2014, they may withdraw from the contract without penalty and without giving any reason within 14 (fourteen) days of receiving the products.
Simply notify your intention to withdraw by email to info@hosmotic.com, by certified email (PEC) to hosmotic@legalmail.it or by registered letter with return receipt addressed to Hosmotic Srl, R. Bosco, 178 - 80069 Vico Equense (NA), Italy.
Within 14 (fourteen) days of the withdrawal notice (art. 57 Consumer Code), the Customer must return the products intact, in their original packaging with outer packaging, free of any damage that may reduce their value, enclosing the delivery note or invoice. Return shipping is at the Customer's expense and responsibility and may be made by any means.
The refund will be made within 14 days of Hosmotic Srl being informed of the decision to withdraw; pursuant to art. 56 of the Consumer Code, the refund may be withheld until the goods are received at our warehouse.
Return shipping costs are borne by the Customer, except for defective products, for which they will be refunded. Refunds are made using the same payment method used for the purchase; for bank transfers, the Customer's IBAN will be requested.
Important: the right of withdrawal requires the product and its packaging to be intact. The right of withdrawal does not apply to customised products.
9. Force majeure
9.1 - In any case of force majeure or unforeseeable circumstances, Hosmotic Srl is not liable for late or failed delivery and reserves the right to terminate the contract in whole or in part, or to suspend or postpone its performance.
10. Jurisdiction
10.1 - The Contract is governed by Italian law. Any dispute concerning the application, performance, interpretation and breach of the Contract falls under the jurisdiction of the Court of Naples, without prejudice to consumer rights.
